1. Acceptance of Terms

By accessing or using the services provided by ByteVic ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use our services.

These terms apply to all visitors, users, and clients who access or use ByteVic's website, platforms, or custom software solutions.

2. Description of Services

ByteVic provides premium software engineering, digital product design, cloud architecture, and technical consulting services. The specific scope of work for any client project will be outlined in a separate Statement of Work (SOW) or Service Agreement.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, including availability of features or content.

3. User Obligations

As a user or client of ByteVic, you agree to:

• Information Accuracy: Provide accurate and complete information when requested for project discovery or account creation.
• Confidentiality: Maintain the confidentiality of any access credentials provided by ByteVic.
• Lawful Use: Use our services only for lawful purposes and in accordance with these terms.
• System Integrity: Refrain from any activity that interferes with or disrupts the integrity of our digital infrastructure.

4. Intellectual Property

ByteVic Property: All content, trademarks, logos, and proprietary technology on our website are the property of ByteVic or its licensors and are protected by intellectual property laws.

Project Property: Intellectual property rights for custom software developed for clients are governed by the specific Service Agreement signed between ByteVic and the client. Unless otherwise stated, ByteVic retains rights to reusable components and proprietary frameworks used in development.

5. Payment Terms

Fees: Fees for ByteVic's services are outlined in the respective project quotes or agreements. Payments must be made according to the schedule specified in the Service Agreement.

Refund Policy: Payments are generally non-refundable. However, in case of duplicate transactions, billing errors, or exceptional circumstances, refunds may be processed at the discretion of ByteVic within 5–7 business days.

Late Payments: Late payments may result in the suspension of services or development sprints. All fees are non-refundable unless otherwise specified in writing.

6. Limitation of Liability

In no event shall ByteVic, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, resulting from:

• Your access to or use of (or inability to access or use) our services.
• Any conduct or content of any third party on the service.
• Any content obtained from the service.
• Unauthorized access, use, or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the services will immediately cease. If you wish to terminate your account or project, you may simply discontinue using the service or follow the termination clauses in your Service Agreement.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding related to ByteVic shall be brought exclusively in the courts located in Kolkata, West Bengal.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
